OFFICIAL CONTEST RULES AND REGULATIONS

WHO CAN ENTER: The Sportchek Diamondback Nordet 700C Electric bike (the “Contest”) is open to all legal residents of Canada excluding Quebec, who have achieved the age of majority in their province or territory of residence on or before April 27, 2023, excluding employees of the Paralympic Foundation of Canada, Canadian Paralympic Committee (the “Contest Administrators”), Sportchek (the “Prize Provider”) and affiliated organizations and each of their respective directors, officers, employees, agents, representatives, advertising or promotional agencies (including their directors, officers, employees) and persons with whom any of the foregoing are domiciled.

CONTEST PERIOD: The Contest starts on April 27, 2023 at 9:00 am Eastern Time (“ET”) and closes May 29, 2023 at 12:00 pm ET, unless suspended or cancelled earlier as set out herein (the “Contest Period”).  All references to time in these Official Contest Rules and Regulations are to Eastern Time. Entries accepted until the end of the contest period.

HOW TO ENTER (Instagram): NO PURCHASE NECESSARY. Participants must either log in to their Instagram account or create a free Instagram account if they do not already have one, at Instagram.com. Before entering the Contest, the “Private Account” option in Instagram’s account settings must be set to “off”. To enter:

1. Follow @paralympicfoundationca and @sportchek on Instagram;
2. Like the @paralympicfoundationca post announcing the Contest and comment below by tagging two friends who you think would enjoy the Diamondback Nordet 700C Electric bike. There is no limit to the number of entries eligible participants may enter, provided that any friend tagged in an entry cannot be tagged in another entry by the same participant; and
3. For one additional entry, share this post on your Instagram story and tag @paralympicfoundationca.

RANDOM DRAW / WINNER NOTIFICATION: One entry will be selected in a random draw from among all eligible entries. The draw will take place on May 29, 2023 at approximately 1:00 pm ET. The selected entrant will be notified by direct message through the Instagram account with which they entered the Contest within 24 hours of their selection. The selected entrant will be required to acknowledge by Instagram direct message their receipt of notification of eligibility for the prize. In order to be declared a winner, a selected entrant must first correctly answer (unaided) a time limited mathematical skill-testing question to be administered by direct message through their Instagram account at a mutually agreed time. The winner may be required to sign and return, within a stipulated period of time, the Contest Administrators’ form of declaration of compliance with the Official Contest Rules and Regulations, release of liability and publicity release. The Contest Administrators reserve the right to require proof of age and jurisdiction of residence prior to awarding the prize. The Contest Administrators will not be responsible for any failed attempts to reach a selected entrant. If a selected entrant has not responded within three (3) business days following the notice, incorrectly answers the skill-testing question, declines the prize, fails to demonstrate eligibility if requested or fails to return the declaration and release specified below, another entrant will be selected until the prize is awarded. The odds of winning the draw are dependent upon the number of eligible entries received.

PRIZE: There is a single prize consisting of Diamondback Nordet 700C Electric bike (approximate value: $2,849.99). The prize must be accepted as awarded, without exchange or conversion to cash, and is non-assignable. The Contest Administrators reserve the right to substitute prizes of equal or greater value in the event that the specified prize is unavailable. 

GENERAL: The Contest Administrators will pay the costs of shipping the prize to the winner. The Contest Administrators are not responsible for any other costs associated with claiming or using the prize, or for any loss, theft or misuse of the prize. The winner is solely responsible for the reporting and payment of all taxes, if any, that may result in claiming the prize in this Contest.

Decisions of the Contest Administrators are final on all matters relating to the Contest, including matters of fact, interpretation, eligibility, procedure and fulfillment in respect to the Contest. The Contest Administrators reserve the right at any time to cancel or modify the Contest or to modify or supplement these rules, without notice, in their sole discretion, subject to applicable law.

By participating in this Contest, the winner consents to the use by the Contest Administrators of their names and hometown for any lawful purpose without further permission or compensation, except where prohibited by law. This would include providing the name of the winner to those who request it and promoting the name of the winner in any marketing vehicles. By entering the Contest, all entrants and the winner agree to abide by and be bound by these Official Contest Rules and Regulations and consent to the use of their personal information to administer, implement and fulfill the Contest.

The Contest Administrators, Prize Provider and affiliated companies and organizations and each of their respective directors, officers, employees, agents, representatives, advertising, promotion and fulfillment agencies and legal advisors are not responsible for and shall not be liable for: (i) website, telephone, electronic, hardware or software program, access provider, server, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled or delayed entry information or computer transmissions or traffic or congestion on the Internet or at any website; (iii) any condition caused by events beyond the control of the Contest Administrators or Prize Provider that may cause the Contest to be disrupted or corrupted; (iv) inaccurate entry information, whether caused by equipment, programming used in the Contest, human processing or otherwise, or any combination thereof; or (v) any injuries, losses or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use or misuse of the prize, or from participation in the Contest.

The Contest Administrators reserve the right, in their discretion, to suspend or cancel the Contest at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Contest. The Contest Administrators also reserve the right to disqualify, in their sole discretion, any person tampering with the entry process, the operation of the Contest Administrator’s account, or who is otherwise in violation of these Official Contest Rules and Regulations. In the Contest Administrator’s sole discretion, it may disqualify entries posted to Instagram accounts made solely for the purpose of entering the Contest. Use of computer programs and/or other automated devices to enter the Contest is prohibited. Posts must be uploaded in accordance with the Instagram Terms of Use: http://instagram.com/about/legal/terms/

By participating in the Contest, each entrant agrees to release and hold the Contest Administrators, Prize Provider, Instagram and their affiliated companies and organizations and each of their respective directors, officers, employees, agents, representatives, advertising, promotion and fulfillment agencies and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use or misuse of the prizes, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy. The Contest is not sponsored, endorsed, administered by, or associated with Instagram.

Any issues concerning the validity, interpretation or enforceability of these Official Contest Rules and Regulations, or the rights and obligations of entrants and the Contest Administrators, shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any conflict of law rules which might find otherwise.
